Privacy Policy

Introduction

Kndrd Inc. is the owner and operator of https://www.kndrd.com, our Kndrd mobile application, and all affiliated websites and other mobile versions (“Kndrd” or we, us, our, ours, etc.). We respect your privacy and are committed to protecting it through this Privacy Policy (the “Policy”). This Policy describes the types of personal information we may collect from you, the user, (you, your, yours, etc.) or that you may provide to us when you use the services offered by us on Kndrd (the “Services”), and our practices for collecting, using, keeping, protecting, and disclosing your personal information.

By accessing or using Kndrd, you agree to this Policy and consent to our collection, use, disclosure, retention, and protection of your information as described in this Policy. We reserve the right to revise, amend, or modify this Policy at any time and in any manner. We will consider your continued use of Kndrd after we make changes to this Policy as your acceptance of the changes.

Collection of Information

When you download the App and create an account (”Account”), Kndrd may collect several types of “personal information” provided by you, including but not limited to:

  • Name;

  • Age;

  • Email address;

  • Cellphone number;

  • Gender;

  • Photographs; and

  • Location

This information is collected by us when provided by you through the account registration process; your profile information or other posts; your purchases and other financial transactions; your search queries; your linked social media accounts; your responses to any surveys we ask you to complete; your other communications and interactions with us, whether by contact form, phone, mail, email, text, or other means, including on third-party social media platforms; and our technologies, including our servers, log files, cookies, pixel tags, and analytics services.

Age Policy

You must be eighteen (18) years of age or older to use Kndrd and we prohibit anyone under the age of eighteen (18) from accessing Kndrd or using the Services.

Kndrd does not knowingly market to or collect or solicit any information from or about anyone under the age of eighteen (18). If we become aware that we have collected information from or about a person under the age of eighteen (18), we will terminate that person’s access to Kndrd and the Services and delete their personal information.

Use of Information

Your contact information will not be shared under any circumstances and will be used solely for the purpose of sending you verification or login codes and for communications from Kndrd to you, the latter of which you have the choice to opt-out from. Your location is approximate [i.e. your neighborhood] and used in order to recommend hangouts happening near you, but your precise location is not displayed publicly. Only your approximate location is shown on your profile. Your precise location is only known to others in the occurrence that you propose or join a hangout and mutually agree upon the location and consent to an in-person hangout at that specific location.

Your personal information will enable us to provide you with access to the Kndrd App and Services. We may use your personal information to personalize your experience with the Services based on your preferences and interests; to recognize when you return to the Services; to notify you about changes to the Services and for marketing or advertising purposes; to improve the quality of the Services; to monitor and analyze the use of the Services; to investigate and prevent unauthorized or prohibited uses of the Services; and for any other purpose with your consent.

Your Safety & Security

Your safety and security are our top priority at Kndrd and we take it very seriously. We aim to create an environment for our community to gather and interact safely and securely both online and in person. As such, we take all possible precautions to safeguard your personal data and ensure that access to it is highly restricted. We also provide you with autonomy of choice around the personal information you directly provide to us. You can delete or restrict any personal data that you provide at any time. You may also delete your account and terminate access to our Services at any time. We have implemented measures designed to protect you and your data and will do our best to ensure it is safe and secure. While we cannot guarantee the security of your personal information transmitted through Kndrd, all information you provide to us is stored on secure servers behind firewalls. However, you understand and agree that the transmission of your personal information over the Internet is not completely secure and while we do our best to protect it, any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures used by Kndrd.

Zero Tolerance Policy

The safety and security of our community members is our primary priority at Kndrd. While we cannot guarantee your safety or security during in-person interactions with other members of the community, we have a strict zero tolerance policy for anyone who does not abide by our code of conduct. Should you encounter anyone or anything, online or in person, who breaches the code of conduct, poses an imminent threat or danger to you or any other members of the community, immediately contact authorities if need be. Then, please report them immediately and we will have them ban from the App and our Services. Please note, your usage of Kndrd is at your own discretion and Kndrd is not responsible or liable. For further information, please refer to the section titled “Code of Conduct” in our Terms and Conditions.

State Privacy Rights

  • Your California Privacy Rights: We do not meet the triggers of California Civil Code §1798.83, because we do not disclose personal information to third parties for direct marketing purposes. We do not meet the triggers of the California Consumer Privacy Act, in part because we do not sell your personal information.

  • Nevada: We do not meet the triggers of Nevada Revised Statute Chapter 603A. While we do not sell your personal information, Nevada residents may submit an opt-out request to support@kndrd.com which we will honor if we sell your personal information at a future date.

  • Virginia: We do not meet the triggers of Virginia’s Consumer Data Protection Act.

  • Colorado: We do not meet the triggers of the Colorado Privacy Act.

  • Connecticut: We do not meet the triggers of the Connecticut Data Privacy Act.

  • Utah: We do not meet the triggers of the Utah Consumer Privacy Act.

California Consumer Privacy Act:

For Users who are California residents, you have the following rights (in addition to those listed at section 10 below) under the California Consumer Privacy Act, and you have the right to be free from unlawful discrimination for exercising your rights under the Act:

  1. You have the right to request that we disclose certain information to you and explain how we have collected, used and shared your personal information over the past 12 months.

  2. You have the right to request that we delete your personal information that we collected from you, subject to certain exceptions.

  3. You have the right to be informed: what personal data an organization is processing and why.

  4. You have the right of access: you can request a copy of your data.

  5. You have the right of rectification: if the data held is inaccurate, you have the right to have it corrected.

  6. You have the right to erasure: you have the right to have your data deleted in certain circumstances.

  7. You have the right to restrict processing: in limited circumstances, you have the right to request that processing is stopped but the data retained.

  8. You have the right to data portability: you can request a copy of certain data in a machine-readable form that can be transferred to another provider.

  9. You have the right to object: in certain circumstances (including where data is processed on the basis of legitimate interests or for the purposes of marketing) you may object to that processing.

  10. You have related to automated decision-making including profiling: there are several rights in this area where processing carried out on a solely automated basis results in a decision which has legal or significant effects for the individual. In these circumstances your rights include the right to ensure that there is human intervention in the decision-making process..

In addition, under California law, operators of online services are required to disclose how they respond to “do not track” signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information of a consumer over time and across third party online services, to the extent the operator engages in that collection. At this time, we do not track our Users’ personal information over time and across third-party online services. This law also requires operators of online services to disclose whether third parties may collect personal information about their users’ online activities over time and across different online services when the users use the operator’s service. We do not knowingly permit third parties to collect personal information about an individual User’s online activities over time and across different online services when using the App.
