Summary

Kndrd Inc. ("Kndrd") provides services through the Kndrd mobile application (the "App") designed to help users connect in person. The "Services" include all of the Kndrd products, features, applications, services, technologies, and software that we provide. These Terms of Service ("Terms") govern your access and use of Kndrd, and provide information about your use of Kndrd and Kndrd's Code of Conduct. The Terms constitute an agreement between Kndrd and its users and subscribers.

Kndrd reviews accounts and messages for breaches and violations of the Terms and our Privacy Policy through automated systems and moderators. We reserve the right to terminate, suspend, or restrict access to the App and our Services for any violations. Please read the Terms carefully.

Code of Conduct

Kndrd is an app to foster connection, create community, and share fun experiences with others. In order to ensure everyone's safety and enjoyment of our Services, we enforce a code of conduct that governs our community.

Any conduct that violates these guidelines is grounds for immediate expulsion. When any Kndrd user or subscriber violates this Code of Conduct, Kndrd reserves the right to expel such user or subscriber and deny access to the App and the Services.

General Guidelines

• Age: You must eighteen (18) years or older to access or use the App and the Services.
• Profile Content: All images on your profile must be of you or include you. Nudity, sexually explicit, or sexually vulgar content or images are prohibited. Your profile content must be an authentic representation of you and may not impersonate or act on behalf of anyone but you. You cannot access another person's Account or share your account with any other person.
• Safety: We have zero tolerance for violence, graphic content, or harassment of any kind. Any content that encourages illegal, violent, or dangerous behavior is basis for immediate expulsion. Should you encounter anyone that you have met through Kndrd, online or in person, who breaches the Code of Conduct, poses an imminent threat or danger to you or any other members of the community, immediately contact authorities. Then, please report them and, upon review, Kndrd will expel such person from the App and ban them from our Services.
• Conduct Guidelines: You agree to behave lawfully and responsibly on Kndrd. You must not act in an unlawful manner.
• Kindness & Respect: Bullying, harassment, and abusive conduct will not be tolerated. Hate and discrimination of any kind – race/ethnicity, sex, gender identity, disability, religion, or other – is strictly prohibited. For the avoidance of doubt, any bullying, harassment, or hateful, discriminatory, or abusive conduct will result in immediate expulsion from the Kndrd App and termination of Kndrd's Services to the individual(s) engaging in such conduct.
• Fun: We encourage fun and expect that by following these community guidelines we'll be able to have lots of it!

The safety, security, and enjoyment of our community is of utmost importance to us. If you come across anyone who does not abide by the Code of Conduct, you can should immediately report such violations to Kndrd.

Using Kndrd

By using Kndrd, you agree to use our Services in compliance with our Terms of Service. You will not use or assist others in using our Services in ways that violate or infringe the rights of Kndrd, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights.

You will not behave online or in person with any members of the Kndrd community that violates the Terms of Service or Code of Conduct, and understand that doing so will result in Kndrd terminating your access the App and its Services. Under no circumstances may you cause harm to Kndrd or its users. This includes, but is not limited to bullying, harassment, abusive behavior, accessing, using, distributing, transferring, or exploiting our Services in unauthorized manners; causing physical, mental, or emotional harm, and violence.

You understand that Kndrd does not provide access to emergency service providers. While we do our best to ensure your safety and security, your use of the App and the Services are at your own will and Kndrd will not be held liable or responsible for the conduct of Kndrd users. In case of an emergency, make sure to contact the appropriate public safety authorities.

Termination of Your Account

Kndrd retains full discretion to determine whether a user or subscriber's conduct has violated the Terms of Service or Code of Conduct and whether such violation will result in termination of a user or subscriber's account.

Limitation of Liability

Kndrd's responsibility for anything that happens using Kndrd's Services is limited as much as the law will allow. You agree that Kndrd will not be responsible or liable for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms. This includes when we delete your account. Our aggregate liability arising out of or relating to these Terms will not exceed the greater of $100 or the amount you have paid us in the past twelve months.
